MTR Bee Terms of Service

Important Notice: These Terms contain a mandatory arbitration clause and class action waiver that affects your legal rights. Please read Section 15 carefully.

1. Acceptance of Terms

Welcome to MTR Bee, a platform that provides furnished housing solutions for construction companies and related businesses. These Terms of Service (“Terms,” “Terms of Service,” or “Agreement”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and MTR Bee, LLC (“MTR Bee,” “we,” “our,” or “us”).

BY ACCESSING, BROWSING, OR USING THE MTR BEE PLATFORM (INCLUDING OUR WEBSITE, BROWSER EXTENSION, AND ANY RELATED SERVICES), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND ALL APPLICABLE LAWS AND REGULATIONS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE OUR PLATFORM.

Your access to and use of the MTR Bee platform is subject to these Terms and all applicable laws. We reserve the right to terminate your access to the platform and seek all legal remedies, including injunctive and monetary relief, if you violate these Terms.

2. Definitions

“Construction Company” means businesses engaged in construction, infrastructure development, or related industries that require temporary housing solutions for their workforce.

“Housing Request” means a submission through our platform requesting crew housing options, including project details, crew size, and timeline.

“Platform” means the MTR Bee website, browser extension, and any related services, tools, or features provided by MTR Bee.

“Services” means the crew housing sourcing, coordination, and management services provided by MTR Bee.

3. Platform Description and Business Model

MTR Bee provides turnkey temporary housing solutions for construction crews. Our business model is designed around the following principles:

Housing Services

MTR Bee sources, coordinates, and manages furnished housing for construction crews. We handle property sourcing, furnishing, utilities, and logistics so companies can focus on their projects.

Pricing

Housing is priced on a per-unit/month or per-person/month basis depending on client preference. All-inclusive pricing covers furnished homes, utilities, and management.

Flexible Terms

We offer month-to-month terms that match project timelines. No long-term commitments required.

4. User Accounts and Registration

Account Creation

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including if you violate these Terms, provide false information, or if we determine that your continued use poses a risk to other users or our business.

5. User Conduct and Prohibited Activities

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Prohibited activities include:

  • Violating any applicable laws or regulations
  • Providing false, misleading, or inaccurate information
  • Impersonating any person or entity
  • Attempting to gain unauthorized access to the Platform or other accounts
  • Using automated scripts, bots, or other automated means to access the Platform
  • Posting content that is defamatory, obscene, abusive, or otherwise objectionable
  • Engaging in price manipulation or anti-competitive practices

6. Payment Terms

Housing Fees

Clients pay MTR Bee for housing services as agreed upon in their individual service agreements. Pricing, payment schedules, and terms are outlined in each client's housing agreement.

Refund Policy

Refund terms are specified in individual service agreements. Refunds may be considered in exceptional circumstances at our sole discretion.

7. Client Responsibilities

Accurate Information

Clients must provide accurate information about their housing needs, including company information, crew size, duration requirements, and any special requirements.

Professional Conduct

Clients must ensure their employees treat rental properties with care and respect, comply with all property rules and local regulations, and honor confirmed bookings.

8. Intellectual Property Rights

The Platform and all content, features, and functionality are owned by MTR Bee and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform solely for its intended purpose as described in these Terms.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

10. Platform Availability and Service Disclaimers

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We strive to maintain Platform availability and functionality, but we do not guarantee uninterrupted or error-free service. We may temporarily suspend Platform access for maintenance, updates, or other operational needs.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MTR BEE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MTR BEE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

MTR Bee is not responsible for:

  • Property condition beyond our management scope
  • Actions or omissions of property owners
  • Force majeure events affecting housing availability
  • Disputes between clients and their employees

12. Indemnification

You agree to defend, indemnify, and hold harmless MTR Bee from and against any claims, liabilities, damages, losses, costs, or expenses arising from or related to your use of the Platform, your violation of these Terms, or your interactions with properties or other users.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account immediately, with or without notice, for violation of these Terms, fraudulent activity, failure to pay fees, or any reason we deem necessary to protect our business or other users.

14. Dispute Resolution and Arbitration

MANDATORY ARBITRATION: You and MTR Bee agree that any dispute arising out of or relating to these Terms shall be resolved through binding arbitration rather than in court.

CLASS ACTION WAIVER: YOU AND MTR BEE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION.

Arbitration will be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitrator must have experience in technology and business disputes.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MTR Bee regarding your use of the Platform.

Modifications

We may modify these Terms at any time by posting the updated Terms on the Platform. Your continued use after such modifications constitutes acceptance of the updated Terms.
